Terms of Service
Mountain Estates Equipment LLC

These Terms of Service (“Terms”) govern your access to and use of the mobile application and related services (the “Service”) provided by Mountain Estates Equipment LLC (“Company,” “we,” “us,” or “our”). The Service is operated on behalf of The Colony at White Pine Canyon and is intended for use by owners, renters, guests, authorized administrators, and designated drivers. By creating an account, using the Service, requesting pickups, signing a waiver, or interacting with any feature of the Service, you (“User,” “you,” or “your”) agree to these Terms. If you do not agree, you may not use the Service.
1. Eligibility
1.1 Age Requirement
You must be 18 years or older to create an account or use the Service. Minors may only ride if:
- A legal guardian signs a valid waiver on their behalf, and
- They ride under the supervision of an authorized adult.
1.2 Authorized Use
Access is restricted to:
- Lot owners
- Renters
- Approved guests
- Administrators
- Authorized drivers
Unauthenticated or unauthorized individuals may not access any portion of the Service.
2. Accounts and Access
2.1 Account Creation
Users must provide accurate information during registration, including a legal name and email.
2.2 Invite Codes and Group Assignment
Invite codes:
- Identify who invited each user
- Are multi-use
- May be revoked by the inviter or an administrator
Users must not share invite codes publicly or use them fraudulently.
2.3 Group Visibility
Users see only:
- Members of their own group
- Names, photos, and queue status of their group
Queue participants from other groups remain anonymized.
2.4 Account Security
You are responsible for:
- Maintaining confidentiality of your login credentials
- Ensuring the accuracy of account information
- Notifying us immediately of unauthorized access
The Company is not liable for unauthorized access resulting from your failure to secure your device or account.
3. Waivers and Legal Acceptance
All users (including guests) must sign a digital waiver before requesting or participating in rides. Your waiver is legally binding and includes: assumption of risk, release of liability, acknowledgment of safety rules, agreement to the terms of emergency handling. Waivers are permanently retained for legal compliance. If you delete your account and later create a new one, you must sign a new waiver.

4. Use of the Service
- By joining a queue or requesting a pickup, you agree to be at the designated pickup point during your assigned window, follow driver and administrator instructions, comply with safety rules, and not interfere with operations.
- If you fail to confirm or appear at the pickup point, you may be removed from the queue, your position may be forfeited or reassigned, and repeated missed rides may result in restrictions.
- Prohibited behaviors include: attempting to bypass queue logic, requesting off-route transport, harassment, unsafe conduct, use of Service for commercial purposes, interfering with operations, or tampering with the app.

5. Driver Policies
- Drivers use company devices and have limited access to rider information (names of active queue participants).
- Driver location is tracked in real time for routing, scheduling, safety, and emergency response; location trails are not stored historically.
- Drivers must follow predefined routes, perform check-ins, verify waiver completion, update trip status, and respond to SOS alerts. Non-compliance may result in removal from driver access.
6. Administrator Permissions
Administrators may manage user accounts, groups, invite codes, queue data, routes, schedules, and respond to SOS alerts. Actions may be logged for security.
7. Emergency SOS Feature
Activating SOS contacts 911, transmits your GPS, name, and group to the active driver and administrators. Drivers may exit predefined loops only for SOS responses. The company is not responsible for external emergency outcomes.
8. Prohibited Uses & 9. Termination
Service may not be used for unlawful conduct, waiver forgery, impersonation, unauthorized access, harassment, or unauthorized security testing. Violations may result in account suspension or removal. Account deletion removes personal data except for waivers and anonymized analytics.
10. Intellectual Property
All app code, route logic, branding, interface design, data structures, and workflows are property of Mountain Estates Equipment LLC. You may not modify, reverse-engineer, copy, distribute, or create derivative works.
11-16. Disclaimers & Other Terms
The Service is provided “as is”/“as available,” and Company disclaims all warranties. Liability is limited to the amount paid (typically $0). Use is at your own risk. You agree to indemnify Company and affiliates. Terms may be updated at any time. Utah law governs.
